1. Acceptance of Terms
By using Fermenting Fairy’s website, products, or services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Services. If you do not agree, please discontinue use of our services immediately.
2. Product Expiration and Shelf Life
Because all Fermenting Fairy products are made fresh and contain live cultures, it is important to observe proper storage and use within the recommended time frames. Below are the standard expiration guidelines after the date you receive your product: -
Coconut Milk Kefir: expires 6 months after receipt
Probiotic Lemonade: expires 6 months after receipt
Sauerkraut and Carrots: expire 6 months after receipt
Apple/Pear Sauce: expires 1 month after receipt
Kefir Hydrating Cream: expires 6 months after receipt
These products should be kept refrigerated unless otherwise stated on the label. Fermenting Fairy is not responsible for
any degradation in quality or safety beyond the listed time frames or due to improper storage conditions.
3. Services
Fermenting Fairy provides information, products, and educational content related to fermentation, including but not limited to fermenting kits, recipes, and resources. All offerings are for educational and personal use only and are not intended to diagnose, treat, or cure any medical condition.
4. Account Registration
Certain features may require account creation. You agree to provide accurate and current information and to maintain the confidentiality of your account credentials. You are responsible for all activity under your account.
5. Product Information and Disclaimer
Our products are designed for personal use. While we promote general wellness through fermentation education, we do not make any medical claims. Always consult a qualified healthcare professional before making changes to your diet or health regimen.
6. Payment and Pricing
Payments are securely processed through approved payment gateways. Prices are listed in U.S. dollars and may change without notice. Taxes and shipping fees are applied at checkout where applicable.
7. Shipping and Delivery
We ship all orders via express overnight service for the fastest possible delivery once your order has been processed. Order processing may take 2–3 business days if the product is in stock. Please note that while we strive to ensure timely arrival, Fermenting Fairy is not responsible for delays caused by FedEx or any other shipping carrier. Fermenting Fairy ships Monday through Thursday only to ensure freshness and prevent weekend carrier delays. We do not ship on Fridays or weekends. We do not ship with ice packs or cold storage. Our products are made fresh and naturally preserved by live probiotics, making them safe and stable during transit regardless of temperature upon arrival. Due to the carbonated nature of our probiotic lemonades, it is imperative that you 'burp' the bottle 1–2 times per week to release built-up gas. Please follow the burping instructions provided inside your package to maintain freshness and prevent excess pressure.

9. Intellectual Property
All content on this website—including text, images, videos, and logos—is the property of Fermenting Fairy or its licensors. You may not copy, distribute, modify, or use any material without prior written consent.
10. User Conduct
You agree to use our services lawfully and responsibly. You will not post, transmit, or share any content that is unlawful, defamatory, or infringes on the rights of others.
11. Limitation of Liability
To the maximum extent permitted by law, Fermenting Fairy and its affiliates shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use
our products or services. Our total liability shall not exceed the amount you paid for the applicable product or service.
12. Payment Disputes, Chargebacks, and Legal Remedies
If a customer issues a stop payment, chargeback, or payment dispute through a credit card company or bank without first contacting Fermenting Fairy, the customer will be permanently blocked from placing future orders. Fermenting Fairy reserves the right to treat any unauthorized chargeback as a breach of these Terms. In such cases, Fermenting Fairy shall be entitled to liquidated damages equal to three (3) times the amount of the original payment, plus recovery of all reasonable attorney’s fees and court costs incurred in pursuing the claim.
Customers agree that any disputes or chargeback-related claims shall be subject to the exclusive jurisdiction of the courts of Pinellas County, Florida. The preferred method for resolving any issue is by direct communication via admin@fermentingfairy.com so that we can resolve it promptly and fairly.
13. Termination
Fermenting Fairy reserves the right to suspend or terminate your access to our services at any time, with or without notice, for conduct that violates these Terms or is harmful to other users or the company.
14. Changes to Terms
We may modify these Terms at any time. Updates will be posted on this page with a revised “Last Updated” date. Continued use of our services after updates constitutes your acceptance of the new terms.
15. Governing Law
These Terms and Services are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law principles.
16. Venue and Jurisdiction
All disputes, claims, or causes of action arising out of or relating to these Terms, our products, or services shall be filed and maintained exclusively in the state or federal courts located in Pinellas County, Florida. You agree that any lawsuit filed against Fermenting Fairy LLC or any of its owners, members, or representatives must be brought in these courts only. By using our website or purchasing our products, you expressly consent to the jurisdiction of these courts and waive any defense of improper venue or forum non conveniens.
